  • Q:Do I need a credit card lawyer?

  • Q:What is the statute of limitations for debt in Florida?

    A:A creditor typically has five years to sue you after you incur debt with them. This means that if your credit company is trying to bring a lawsuit against you, and it has been over five years, hiring an attorney is a good idea. However, some types of debt have their own specifications for a statute of limitations. If your debt is for personal injury or property damage, the time is four years. For unpaid property tax, it is 20 years. For fraud, it is 12 years. And for unpaid alimony, there is no time limit.

  • Q:What is considered harassment by a creditor? Do I need an attorney?

    A:There are several different forms of harassment by creditors. The most popular are constant phone calls intended to upset you, abusive language such as profane words or threats of harm, publishing your debt information publicly, and refusing to tell you who they are when contacting you. They should also not be intentionally misleading, as in the case of telling you that you may be arrested or that you are speaking to a lawyer when you're not. If you have any suspicions that your debt company is harassing you, you should speak to an attorney.

  • Q:When should I hire a student loan lawyer?

    A:It is a good idea to hire a student loan lawyer if you have either private or federal loans and are being sued, have a loan servicer or debt collection agency that is harassing you, or you need an advocate for serious issues surrounding your loans. Trusting a for-profit loan servicer will not ensure your best interests are being looked after.
